The Need and Necessity of UCC

The UCC will eliminate disparities of separate religious and personal laws and contribute to the improvement of the women’s conditions in India

The uniform civil code has again reached to the centre stage and attracted attention and limelight due to the recent statement of Home Minister Amit Shah in Himachal Pradesh wherein he has stated that UCC will be enacted and implemented in the state if BJP comes to power. It is the irony of India that many issues of national and public issues of importance have become controversial thanks to the appeasement and vote bank politics of so called secular political parties. One such issue is the uniform civil code for all Indians. It is disturbing and unfortunate that every time sincere efforts are made by the NDA headed by the BJP, these efforts are opposed tooth and nail by the secular parties and the process to adopt and apply UCC for all Indians is every time derailed simply for the sake of minority appeasement and thus national interests and national good as well as national unity is overlooked and disregarded. There is utmost need and necessity for adoption and application of the uniform common code throughout India for justice, fairness and equal treatment to all including the women and other vulnerable sections of the society.
Therefore as responsible citizens of the country and responsible political parties, there should be no opposition and hindrance to the enactment and application of the law regarding common civil code and the enactment and application of the common civil code will be a historical development and all political parties should raise above selfish politics and cooperate with the government to facilitate the enactment of the law of common civil code and not make it a political issue. Thus for the national and public interest common civil code should be made a reality. It is pertinent to know what the meaning of UCC is and what its necessity is. Uniform civil code means a same civil law for all citizens which will ensure justice for all and make national unity and integrity possible. It is very unbecoming that we have same criminal laws for all Indians irrespective of faith but we do not have uniform civil laws for all even after more than seven decades of in dependence of the country. The enactment of the common civil code has remained on the agenda of the BJP from its inception and even its former incarnation, Bharatyia Jansangh had this issue in its agenda.
The UCC is one of the core issues to BJP and it has fulfilled other two core issues of the abrogation of controversial issue of article 370 of the constitution and has made road clear for the construction of the Ram temple in Ayodha and in fact the construction of the grand Ram temple is in full swing and very soon it will be completed and the temple opened for the public. Now only UCC remains to be enacted and implemented and it is expected that in near future there will be a law on common civil code. The UCC aims to provide protection to vulnerable sections as envisaged by Ambedkar including women and religious minorities, while also promoting nationalistic fervor through unity. The concept of UCC will end conflicting personal and religious laws, bringing all citizens under one law irrespective of religion and gender. The UCC is necessary in order to further national integration, gender justice, equality and dignity of women. The article 44 of the constitution states that, “The state shall make endeavour to ensure for its citizens a uniform civil code throughout the territory of India.’’ Thus when efforts are made to enact the UCC enough hue and cry is made by the secular parties and satraps. The enactment of the common code for all Indians is enshrined in the Directive Principles of The State Policy as such these are not enforceable by any court as these are mere directions. Uniform common code is a separate set of rules that basically covers the personal matters of Indian people without prejudice or regard for the religion in order to safeguard the fundamental rights and constitutional rights of the citizens.UCC will address the gender disparity produced by the specific religious laws.
The UCC will eliminate disparities of separate religious and personal laws and contribute to the improvement of the women’s conditions in India. It will address personal laws that constitute a loophole in the legal system. A uniform civil code will contribute more to India’s integration and therefore UCC is badly required in the country. National integration is the prime need of India having so much diversity and the UCC will ensure much needed national unity and integration and so it is the need of the hour. By enacting and implementing of UCC ,all citizens will be treated the same-all the laws related to marriage, inheritance, family, land etc will be equal for all Indians.UCC is the only way to ensure that all Indians are treated equally. Therefore UCC will be a reformative, dynamic and progressive and it will revolutionalise the personal laws and will substitute in their place common civil laws which will bring not only gender equality but will also ensure national unity and pride.
The need for uniform civil laws can be enumerated in the following war—1-The UCC will address and remove gender disparity produced by specific religious laws. India is notorious for patriarchal and misogynistic traditions perpetuated by society and ancient religious norms that continue to dominate family life. These subject Indian women to subjugation and cruelty and it will be eliminated to a vast extent by framing and applying UCC for all irrespective to religious faith.2-The UCC will address personal laws that a loophole in the legal system. It is very sad that Panchayats continue to issue verdicts that violate our constitution and no action is taken.
Human rights are abused throughout our country by horror killing and female foeticide. These undesirable things will be shown the door by UCC.3-The UCC will aid in the integration of India. A uniform civil code will contribute more to India’s integration and national unity which is required badly in the country because of our diversity.UCC will contribute to the unification of all Indian’s regardless of caste, religion, or tribe.4-The UCC will ensure that all citizens have an equal status. Equal laws in the areas of marriage, inheritance, family, land and other things are required.UCC will serve as a saviour, bringing everything under one roof and it will simplify the complex personal laws by substituting the same civil laws for all the citizens. 5-The UCC will also aid in reducing vote bank politics which has become a perennial problem and so there is urgent need to stop vote bank politics and the UCC will act as a brake on the vote bank politics.
When all religions are subject to same laws, there will be no room for politicising issues of discrimination, concessions, or special privileges enjoyed by a community on the basis of their religious personal laws.6-The Adoption of the UCC will promote real secularism. We practise selective secularism and the UCC will put an end to this and will promote secularism in real sense. A uniform civil code requires all citizens of country to adhere to same set of laws, regardless of whether they follow Hinduism, Islam, Christianity or Sikhism.
The people’s right to freedom of religion will not be affected by applicability of UCC to all citizens belonging to different faiths. 6-The aspirations of the youth who constitute 55% of the population will be met by enacting and implementing the UCC. 7:- It can help to keep pace with the global progress. A uniform civil code has become the hallmark of modern progressive nations legal structure .It demonstrates the nations transition away from caste and religious Politics. Over the years there have been numerous judgments ruled by the supreme court of India where it directly or indirectly recommended UCC .Diversity is the essence of India but diversity in laws cannot be continued as these harm equality especially gender equality in the country and it is unjust. As UCC would establish several laws to regulate individual situations affecting all people regardless of faith, this is both necessary and the corner stone of secularism. In short there is dire need and necessity of framing and applying the UCC for all Indians irrespective of religion and the enactment of the UCC will be a revolutionary step in the right direction.
